1. Acceptance of Terms

By accessing or using PonPon (“the Service”), operated by PonPon Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use the Service.

2. Description of Service

PonPon is an AI-powered media generation platform that allows users to create images, videos, and other digital content using artificial intelligence models. The Service is provided on an “as-is” and “as-available” basis.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up-to-date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. User Content & Generated Content

You retain ownership of the prompts and inputs you provide to the Service (“User Content”). Subject to applicable AI model license terms, you are granted a license to use content generated by the Service (“Generated Content”) for personal and commercial purposes.

You agree not to use the Service to generate content that is illegal, harmful, infringing, defamatory, obscene, or otherwise objectionable. We reserve the right to remove any content that violates these terms.

5. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or to generate illegal content
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Circumvent any rate limits, access controls, or security measures
• Resell, sublicense, or redistribute access to the Service without authorization
• Use automated means (bots, scrapers) to access the Service beyond normal API usage
• Generate content that impersonates real individuals without consent

6. Pricing & Payments

Certain features of the Service require payment. All fees are stated in US Dollars and are non-refundable unless otherwise specified. We reserve the right to modify pricing with 30 days notice. Continued use after a pricing change constitutes acceptance of the new pricing.

7. Intellectual Property

The Service, including its design, branding, software, and documentation, is owned by PonPon Inc. and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, PonPon Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimers

The Service is provided “as is” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any provisions that by their nature should survive termination shall survive.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in San Francisco County, California.
